Terms Of Service:
By agreeing to purchase a product from Kara Cat Creations (the artist) and sending payment, you are indicating that you (the client) are legally an adult (18 years old or over) and have read and agree to all of the terms outlined below and in the Artist Commission Contract as designated for your individual project.
CONDITIONS OF SALE
Reference material of a clear and concise nature, (or a thorough description of your request) must be provided by the client via email before the artist will give a preliminary quote. This means a front, back, and side view as well as any important details or asymmetrical pattern needs. Any unclear or otherwise unacceptable concept art will be turned down. No NSFW images please.
Any deadlines must be divulged by the client in their initial quote request email to the artist before any deposit or agreement to start work is made. The artist reserves the right to turn down work with unobtainable or unreasonable deadlines.
Rush orders and all fees related to such are on a case by case basis and are up the the artist's discretion. Any/all rush fees will be clearly communicated to the client and included in the initial quote. Rush fees are rolled into the overall commission costs and will be billed proportionately across the billing schedule.
The client acknowledges that any requests of an artistic style different from the style presented in the artist’s sample image(s) will be turned down, and that all reference images submitted for quotes/commissions will be translated into the preferred costume style of the artist. Kara Cat Creations does realistic and semi-realistic costume work to the best of our current ability. This means no toon style work or quad suits.
The work we produce is consumer quality, wearable art, but is to be treated as fragile. These costumes are in no way meant for use in performance, or other professional applications. Please let us know if you require extra durability for end use, so we can provide extra durability during construction and quote you accordingly.
MEASUREMENTS
All measurements asked for need to be current and provided in a timely manner.
A current duct tape dummy (DTD) is required for all personal full-body costume projects. Your project(s) will not be set to a schedule until the DTD is received. If a DTD is not received in a timely fashion then the artist reserves the right to cancel the project.
Any client DTD received without the seams taped satisfactorily will incur a $50 labor surcharge for time and materials.
Please mark the DTD with your name and/or project so it can be easily identified.
PAYMENT
The product will be sold for the price* settled upon via communications between the client and the artist as written and signed in the Artist Commission Contract.
*Any changes made and agreed on, and their incurred surcharges and fees are included in the price.
30% of this final price is non-refundable upon termination of the project contract. This termination fee covers the artist's lost time and wages spent on consultation, research, and design of the project (even if no product has yet been made). Upon termination, the client will not be entitled to any of these pre-commission designs or materials as they are solely the intellectual/physical property of Kara Cat Creations. The original reference and character remain property of the client.
All prices are in USD (American Dollars). Payment is accepted via Paypal, banker's/cashier's check or money order.
SAFETY and CARE
The product is to be considered fragile and may become damaged over time or with misuse. Please handle with care. We typically use a cast plastic base for masks and other costume parts. We take care to ensure our parts are as durable as possible, but we cannot rule out the potential for an item to fracture causing damage to the costume and potentially the wearer. We recommend wearing a balaclava to protect yourself from parts that may become damaged, and also protect the mask from natural body oils and sweat.
When wearing a mask it is our recommendation that you have a handler to assist with safety concerns. Masks typically have restricted vision, and while we try to give the best sight lines possible there are many hazards that can be missed without assistance. We want you to have fun, but please keep yourselves safe.
These masks and suits get HOT. Stay hydrated, take regular breaks, and ideally avoid athletic use. Please be discerning. Once your costume has left the hands of Kara Cat Creations it is your responsibility for use, maintenance, and safety.
By completing your purchase, you acknowledge and accept the risks associated with your commission and agree to hold Kara Cat Creations and it's employees harmless for any liabilities arising from use.
WARRANTY and REFUNDS
Once the product is completed and shipped if sizing or fitting issues occur the suit will be altered for free within the first 90 days.
During the initial three month time period from receipt, if there are any failures of the suit due to manufacturing faults (adhesion failure, popped seams) these will be repaired and shipped back to you at the artist's expense. You must cover insured shipping to KCC. KCC is not responsible for losses or damage in post.
After three months from receipt, shipping to and from the artist will be at the cost of the client, and they may be charged for the cost of any materials or labor.
This above warranty is void under misuse of the costume by the client. It does not cover sizing issues caused by a poorly-made DTD nor does it cover any changes in the client's preferences or proportions since when the DTD was made.
Misuse include lack of cleaning, rough-handling (as outlined in the care sheet included with each purchase), or any physical adjustments to the costume (cutting/gluing/etc). The warranty does not cover catastrophic events such as (but not limited to) flooding or fire.
Any extra/non-quoted changes/additions to the suit desired after completion (if accepted by the artist) will be charged at an hourly rate + materials.
As our work is a custom, handmade, wearable piece of 3D art, and not a mass-produced product, expect some variations between pieces. Some components may be fragile, and all will require proper care and maintenance to ensure the longevity of the costume.
CANCELLATIONS and RETURNS:
The artist reserves the right to cancel/terminate any commission; at any stage of the process; if the client is rude, threatening/dangerous, or otherwise unreasonable to work with.
During the commission, If the client cannot be contacted by the artist (via the contact information supplied by the client in the original project Artist Commission Contract form) within a reasonable time frame (and no warning/explanation was given for the absence), the commission will be considered abandoned and the commission will be canceled after 1 month of no contact.
Commissions terminated by the artist will have any due balance as described in the Artist Commission Contract returned, minus the 30% non-refundable deposit, unless otherwise negotiated.
Any costume that cannot be delivered (due to lack of payment and/or delivery address) will be held for 3 months (incurring a $25/week storage fee) and then sold.
Kara Cat Creations assumes no liability for incorrectly reported delivery addresses, and cannot refund or replace lost merchandise for such.
Once the costume has been delivered there are no returns accepted.
The client understands that due to the nature of the product being both custom as described by the client at the time of commission, and bespoke to the clients specific proportions during the making of their DTD, there are no refunds and as such we cannot guarantee satisfaction of the final product.
